Es la principal instancia para el desarrollo de la participación y democracia que reúne a los integrantes de la Comunidad Educativa, con el fin de mejorar la calidad de la educación y la Convivencia Escolar.

El Sistema de Educación Pública potencia esta instancia, introduciendo modificaciones acotadas, pero significativas. Así, se les otorga a los Consejos Escolares constituidos en los establecimientos educacionales dependientes de los Servicios Locales atribuciones resolutivas permanentes respecto de:

El calendario detallado de la programación anual y las actividades extracurriculares o extraprogramáticas, incluyendo las características específicas de éstas.
Aprobar el reglamento interno y sus modificaciones.

Se crea también la figura de los Consejos de Educación Parvularia (equivalentes a los Consejos Escolares), en todos los establecimientos educacionales subvencionados que imparten exclusivamente educación parvularia. Asimismo, se obliga a los Consejos Escolares de escuelas que impartan educación básica y/o parvularia a fijar en su acta constitutiva las instancias que permitan considerar las opiniones de los niños que asistan al establecimiento.
